THE BUZZ: Less than a year after the U.S. Supreme Court repealed the federal constitutional right to abortion, Americans are again preparing for a decision that could rock the landscape of reproductive rights.

California Democrats are keeping a close eye on the ruling expected to come out of the Supreme Court today, determining whether a federal judge in Texas was correct in revoking Food and Drug Administration approval for mifepristone — the abortion pill used in more than half of the nation’s pregnancy terminations.

In the months since POLITICO first published details of the Supreme Court’s decision to overturn Roe v. Wade last spring, state leaders have vowed to be a safe haven for abortion seekers. A slate of bills signed last year attempted to shore up those protections. But despite the legislation and forceful rhetoric from those like Gov. Gavin Newsom, the Supreme Court’s actions today could seriously curtail access to the abortion pill in California.

The governor joined fellow elected leaders on Tuesday to reaffirm a commitment to reproductive rights — and warn that California will do all it can to ensure residents still have access to abortion medication. Last week, Newsom announced a stockpile of the companion abortion pill, misoprostol and said Tuesday he was supporting new legislation that would ensure privacy of patients and providers, especially those from out of state, and protect pharmacists dispensing mifepristone — though such bills aren’t in print and don’t yet have an author.

Attorney General Rob Bonta made it clear that California is willing to throw its full weight behind protecting abortion access, both in and out of state. The California Justice Department is working with other blue states on a legal strategy, Bonta said. California was notably not one of the 18 that sued in a federal court in Washington state to protect FDA approvals for mifepristone, a move the attorney general said was strategic.

Bonta said a coalition of blue states have devised a "divide and conquer" strategy on abortion, and that states like California and New York need to keep communication channels open.

"We believe it's important to have some states, including California, that continue to collaborate, partner and work with the federal government,” he said Tuesday.

Regardless of what the justices decide, the post-Roe world will continue to test California’s legal ability to influence abortion access outside its borders. Lawmakers this year are introducing bills aimed at preventing red state actors from going after abortion patients and providers and made it clear that they’re willing to cross state lines to do so.

“This is not a fight we can win by focusing solely within the California borders,” Assemblymember Cecilia Aguiar-Curry said on Tuesday.

BUENOS DÍAS, good Wednesday morning. A bill that would amend the constitution to give incarcerated Californians voting rights gets its first hearing today. ACA 4 by Assemblymember Isaac Bryan would ask voters to decide if those serving time for felonies in state and federal prisons should be able to cast ballots while behind bars.

The bill is up in the Assembly Elections Committee, which Bryan chairs, this morning at 9 a.m.
