What’s in Biden’s ethics pledge — Watchdog groups want financial disclosures to go farther — Chamber kicks off infrastructure push

BIDEN SIGNS LOBBYING BAN FOR APPOINTEES: Included in the 17 executive orders President Joe Biden signed on his first day in office was his administration's ethics pledge , which builds on former President Barack Obama's and closes loopholes in the previous administration's ethics pledge that former President Donald Trump revoked at the last minute of his presidency.

— How does it compare? Biden's rules restore the Obama-era bans on appointees participating in matters relating to a former employer, lobbying client or lobbied agency for two years. The order also restores a two-year ban on former appointees registering to lobby but goes further by extending a ban on lobbying the executive branch. Whereas Obama's ethics pledge banned lobbying the executive branch until the end of his term, Biden's bans such activity until the end of his administration, or for two years, whichever is later.

— The Biden ethics pledge also clamps down on so-called shadow lobbying — a top demand of good-government watchdogs — banning former officials from working behind the scenes to lobby until one year after they've left the government and prohibiting senior officials from holding out to lobby for one year. Biden's order also commits to making any ethics waivers issued by the administration public within 10 days, while offering more guidance for issuing waivers than Obama's did.

PROGRESSIVES WANT MORE FROM DISCLOSURES: More than three dozen progressive watchdog and foreign policy groups wrote to Biden today to ask for more details about his appointees and nominees' private sector work as outlined in financial disclosures. The letter, which was signed by groups like the Revolving Door Project, Project on Government Oversight, CODEPINK and more, notes "the corporate clients referenced in the disclosures released so far include a number of firms with significant stakes in federal and international policymaking."

— They highlighted the data-mining company Palantir, which has contracts with agencies like the Defense Department and U.S. Customs and Immigration Enforcement and which paid Biden's newly confirmed Director of National Intelligence Avril Haines $180,000 for consulting according to her disclosure. The letter also noted that the Senate panel handling Tony Blinken's nomination for secretary of State has asked for more details on his consulting work as well.

— The groups commended Biden's ethics pledge, which requires appointees commit "to decision-making on the merits and exclusively in the public interest, without regard to private gain or personal benefit." The groups urged that Biden require his appointees provide a "detailed description" of their private sector work, how they came to represent corporate clients, how they advised clients related to federal procurement and describe investments otherwise "not readily intelligible."

BUSINESS LOBBIES RAMP UP INFRASTRUCTURE PUSH: PI reported last week that the U.S. Chamber of Commerce and Bipartisan Policy Center are pushing hard for an infrastructure deal by this summer. Today, the groups unveiled more details about that effort, putting some financial muscle behind it with a six-figure TV and digital ad buy. A 30-second spot rolled out today urges Biden and Congress to make investing in an ambitious infrastructure plan "job number one." The push will appear in D.C. news outlets and tipsheets as well as on social media and online, the groups said.

— Despite a rush of legislative proposals the last few weeks (Biden has rolled out a framework for both immigration reform and coronavirus relief, while the House and Senate have assigned the symbolic H.R. 1 / S. 1 designation to a package of government and election reforms) the new president has not formally rolled out an infrastructure package yet, though the second prong of his coronavirus relief plan is expected to contain some infrastructure initiatives. Biden has a very narrow path to enacting an infrastructure bill , needing to win 10 Republican votes in the Senate without losing the support of the chamber's progressive wing if Democrats opt against budget reconciliation.

NEW MAJORITY, NEW RELIEF FIGHTS: Democrats are now, by the thinnest of margins, in complete control of Congress and eager to pass the kind of comprehensive coronavirus relief they ran on providing. But "that's about where the agreement ends," our Heather Caygle, Sarah Ferris and Caitlin Emma report. "Though President Joe Biden rolled out a $1.9 trillion relief proposal last week, big questions have yet to be settled in the Capitol, including what exactly Speaker Nancy Pelosi and Senate Majority Leader Chuck Schumer will put forward, if Republicans will participate in negotiations or even when Congress will act. What Biden, Pelosi and Schumer decide — and how much GOP cooperation they get — will do much to shape the direction of Democrats' first opportunity to govern in a decade."

— White House Press Secretary Jen Psaki told reporters last night that a bipartisan bill is Biden's "clear preference," but wouldn't rule out pushing a relief package through with only Democratic support. Brian Deese, the head of Biden's National Economic Council, is set to meet with a bipartisan group of lawmakers about the plan in the next week, Bloomberg's Josh Wingrove and Jenny Leonard report.

THE THEMES IN TRUMP'S PARDONS: Trump's final wave of pardons, issued with less than 12 hours left in his presidency, included former politicians rung up for various corruption charges, a top donor charged with illegally lobbying on behalf of a foreign power, and other allies including his former campaign strategist and the lobbyist former husband of Fox News host Jeanine Pirro. The last-minute moves by Trump illustrated "a theme that coursed through the more than 235 pardons and commutations he issued during his presidency — a disdain for a justice system that seeks to hold public officials to account for violations of the public trust," The New York Times' Eric Lipton and Ken Vogel write.

— That trend in pardons "galled government watchdogs, ethicists, public officials and even some supporters of greater use of clemency. They said they worried that Mr. Trump's use of the power to reward friends and allies, and to undermine legitimate investigations, ran counter to its intent of showing mercy to deserving recipients without regard to political connections or wealth. While other presidents used their pardon powers expansively, they relied heavily on a formal Justice Department review process that Mr. Trump largely ignored, and none so overtly linked their decisions to their own political grievances."

— Trump's acts of clemency while in office also served to undercut a resurgence in the Justice Department's FARA enforcement, attorney Joshua Rosenstein argues in an op-ed for Foreign Lobby . "In the course of a few months, the president's pardons wiped clean the records of some of the most prominent foreign influence actors in recent history, and undid much of the last decade's successful FARA enforcement activity," he wrote, calling Trump's pardons "a setback for the years-long effort to enforce FARA more aggressively."
