AN EXPENSIVE LOSS: Apple shelled out more than half a million dollars for just a little over a month’s work as it unsuccessfully fought to convince the White House to veto a ruling in a patent dispute that could lead to an import ban on some versions of the tech company’s popular Apple Watch.

— Apple hired Covington & Burling’s Shara Aranoff, who chaired the International Trade Commission during the Obama administration, to lobby on the patent dispute in early January, disclosures show. A month earlier, the ITC ruled that Apple devices’ heart-monitoring equipment infringed on patents of the Silicon Valley startup AliveCor, paving the way for a ban if the underlying patents from AliveCor are upheld by the Patent & Trademark Office.

— The Biden administration declined to exercise its authority to overturn the ruling, which AliveCor announced Feb. 21. A disclosure filed Wednesday shows Apple’s contract with Covington was terminated a day before AliveCor announced the White House’s decision.

— The firm’s month of work didn’t come cheap, ringing up at $540,000, according to the termination filing. Covington reported more than a dozen different federal entities — including USTR, the White House Office, the National Security Council, the National Economic Council and the Commerce Department — on trade, intellectual property and public health matters, including the ITC Apple Watch investigation.

— An ban on Apple Watches isn’t inevitable, however. The U.S. Patent Office’s trial and appeals board ruled in December that AliveCor’s patents are invalid, though the startup has said it will continue fighting the decision.

MID-SIZE BANKS GROUP SPLITS WITH VENABLE: The trade organization representing mid-size banks in Washington parted ways with one of its last remaining lobbying firms earlier this year, newly filed disclosures show, just months before the collapse of two of its former members, Silicon Valley Bank and Signature Bank, sent shockwaves through global financial markets. The Mid-Size Bank Coalition of America, which hired Venable back in 2021, split with the law and lobbying firm Dec. 31, according to a termination filed today.

— That means the trade group was left with just one lobbying firm, Mindset Advocacy, on retainer as federal banking regulators scrambled to contain the damage of the two shuttered banks and mid-size lenders in particular faced heightened scrutiny over their lobbying to loosen regulatory guardrails.

— The association paid Mindset just $20,000 during the first three months of the year for introductory meetings and lobbying on financial banking regulation, according to disclosures filed earlier this week. It spent $180,000 on federal lobbying in all of 2022, a paltry total compared to other Wall Street lobbying groups.

— In the wake of the bank run that prompted regulators to shut down Silicon Valley Bank and sparked an exodus of deposits to larger banks, Mid-Size Bank Coalition urged them to extend federal deposit insurance to all deposits for the next two years, Bloomberg reported.

MORE NOTABLE TERMINATIONS: Disclosures coming in ahead of tonight’s first quarter filing deadline better show the extent of PhRMA’s lobbying shakeup following the industry’s drug pricing defeat. The trade group, one of K Street’s perennial top spenders, has parted ways with seven of its outside lobbying shops since the end of the year.

— The latest rolling in this week included Cassidy & Associates, Tiger Hill Partners, Klink Campaigns and Federal Health Counsel. The trade group has brought on two new firms in the same period, hiring Bose Public Affairs and Convergence Public Affairs, according to registrations filed this month.

— The PhRMA-funded initiative We Work For Health has also cut ties with a slew of its outside lobbying firms since 2022, parting ways with Tiber Creek Group, Bravo Group, Junto Solutions, Desimone Consulting, Bose Public Affairs and Klink, according to disclosures filed over the past few weeks.

ANNALS OF CAMPAIGN FINANCE: Never Back Down, the super PAC formed earlier this year to support Florida Gov. Ron DeSantis’ as-yet-unannounced 2024 presidential bid, is poised to take on an outsize role in field operations for the impending campaign, The Washington Post’s Michael Scherer, Isaac Stanley-Becker and Ashley Parker report, further testing the limits of how committees legally prohibited from coordinating with candidates are able to wield unlimited amounts of campaign cash.

— “The arrangement marks a new frontier in the rapidly shifting campaign finance landscape that governs presidential efforts, as outside groups allied with candidates behave more and more like traditional campaigns.”

— “Made possible by a pair of court decisions in 2010, super PACs have steadily evolved since, from deep-pocketed attack ad operations to sprawling organizations that undertake much of the work of a campaign, including candidate fundraising, strategic operations, polling, opposition research and communications.”

— “Though super PACs are technically barred from coordinating major spending to influence an election with the candidates they support, the walls of demarcation mean less in practice. Little has stopped prospective candidates from working with their super PACs before announcing their campaigns.”

— “Officials at Never Back Down — which is led in part by Phil Cox, one of the governor’s top political advisers — has been telling donors they intend to push the bounds of what an independent effort can do in presidential years. That includes a major push into the sort of organizing in early states that has historically been undertaken by candidates themselves.”

DEMS DEMAND USDA SCRAP CONTRACTS WITH MEATPACKER: Sen. Elizabeth Warren (D-Mass.) and Rep. Jamie Raskin (D-Md.) have asked the Department of Agriculture to toss contracts with meatpacking giant JBS USA over a slew of recent controversies, our Marcia Brown reports, “arguing that federal dollars shouldn’t be going to a company with ‘a history of criminal misconduct.’”

— “In a letter sent Wednesday, the lawmakers wrote that USDA must wield its authority to ‘curb misconduct’ by revisiting its 2021 decision to continue federal contracts with JBS USA, one of the nation’s biggest meatpackers.”

— “USDA told Congress last fall that it would not stop buying meat from the company, explaining in a letter that there were too few competitors and it would raise prices for taxpayers. USDA has awarded JBS USA and subsidiary Pilgrim’s Pride $118 million from October 2020 to April 2023, according to the lawmakers’ letter.”

— “In the November letter, first reported by POLITICO, Agriculture Secretary Tom Vilsack wrote that USDA had considered ‘suspension or debarment proceedings’ against JBS USA after its parent company, J&F Investimentos, pleaded guilty to bribing Brazilian officials in 2020. The parent company paid a $256 million fine to resolve the charges with the Department of Justice.” Stateside, JBS USA faces heat for alleged price-fixing and became ensnared in a recent child labor probe by the Labor Department.

OUTSIDE GROUPS SQUEEZE SWING SEAT SENATORS: Business and conservative advocacy groups are ratcheting up their pressure campaign to sink Julie Su’s nomination to be Labor secretary, homing in on a cadre of senators facing tough reelection fights next year.

— “We are alarmed that Ms. Su’s anti-small business record shows that she will likely stretch the law, rather than enforce the law, as Labor Secretary in a manner that would shutter small businesses and increase costs for consumers, especially as the economy continues to struggle,” state affiliates of the National Restaurant Association, Associated Builders and Contractors, International Franchise Association, National Association of Manufacturers, American Trucking Associations and more wrote in letters to Sens. Kyrsten Sinema (I-Ariz.) and Joe Manchin (D-W.Va.) ahead of Su’s confirmation hearing this morning.

— The state groups mirrored their national counterparts’ and Republicans’ criticism of Su’s record as California’s top labor official, pointing to her support for the state’s contentious (and now overturned) gig worker law and her support since becoming deputy Labor secretary for California’s similarly contentious fast food labor overhaul.

— Koch-backed Americans for Prosperity, meanwhile, launched a digital ad buy in D.C., West Virginia, Arizona and Montana — where Democratic Sen. Jon Tester’s seat is a top GOP target — warning that Su would turn the lawmakers’ red and purple states “into California,” an assertion that echoed business groups opposed to Su’s nomination.

This includes using advanced technology to inspect and assess our network, helping us ensure our infrastructure and equipment remain sound. Despite these efforts, recent incidents have shown that there is more work to do, and we will take the lessons learned to get safer each day.

Proactive, transparent and collaborative measures with communities and policymakers are key. That’s why we’re installing an additional 1,000 hot bearing detectors, providing even better training and support for first responders, and improving collaboration across rail companies so we can make informed decisions based on shared data.
