POLITICO Florida Playbook: DeSantis, Moody get dinged for 'Sweet Florida' promotion

Good Thursday morning.

Gimme Three Steps — You can tell when election season is moving into full gear when the legal complaints start getting filed. And the first ones are aimed at Gov. Ron DeSantis and state Attorney General Ashley Moody.

Call Me the Breeze — Last week, the governor and his reelection campaign touted "Sweet Florida," a song performed by Johnny and Donnie Van Zant that is a paean to the Republican governor's stewardship of the state. "Our governor is red, white and blue," the Van Zant brothers sing at one point. The tune got its debut on Fox News and then later that same day got a shoutout and even some joking by both the governor and Moody at a bill-signing ceremony for the new measure that provides incentives to police officers to move to Florida.

Free Bird — DeSantis at one point during the event said "yes, you can go to SweetFloridasong.com. I think people like it. I like it." Moody said "consider moving to sweet, sweet Florida. If those of you don't know what that means, there was a video released today by the Van Zant brothers that says Florida is sweet, sweet Florida. And our governor stars in that."

Double Trouble — American Bridge 21st Century, which does opposition research and supports Democratic candidates, says the promotion of the website violated Florida election law because DeSantis and Moody did it at an official state-sanctioned event. The group this week filed complaints with the Florida Elections Commission, where it noted that the "Sweet Florida" website is paid by the DeSantis campaign (there's even a disclaimer on it) and it contains donation links.

On the Hunt — "When someone shows you who they are, believe them — and Ron DeSantis and Ashley Moody have shown us that they are more interested in financial and political gain than serving the people of Florida," American Bridge president Jessica Floyd said in a statement shared with Playbook. "We expect our elected officials to be held to the highest ethical standards, but Ron DeSantis and Ashley Moody have broken the law by using taxpayer dollars to get re-elected. We are holding them accountable."

Don't Ask Me No Questions — The campaigns for both Moody and DeSantis did not have any immediate response to the complaints. The caveat here of course is that the Florida Elections Commission moves notoriously slow — and has a history of sidestepping serious election law violations. Past campaign seasons have been littered with a flurry of complaints that yielded no results. But that probably won't stop Democratic and Republican operatives from filing a bunch of them in the weeks and months ahead.

You Got That Right — The one other important point: Florida's top elected officials, including DeSantis and Agriculture Commissioner Nikki Fried, have had plenty of official events since taking office that acted and seemed more like campaign rallies or campaign press conferences. Their taxpayer-paid staff have also appeared to act more as political functionaries than government employees at times. Is there a bright red line? It certainly doesn't seem so anymore. But it's not clear that the state's elections commission will fix that.

Rick Scott on Wednesday showed an unwillingness to embrace the harsh rhetoric of Gov. Ron DeSantis over Disney's rejection of Florida's "Parental Rights in Education" bill, dubbed the "Don't Say Gay" bill by opponents. Scott said he supports the legislation and complained during a lengthy television interview on Bloomberg Television and also on Twitter about "woke companies" such as Disney, which also came under fire for not taking a stance on the bill until Florida lawmakers approved it. But the former two-term governor sidestepped a question on whether Florida legislators should repeal a half-century state law that created a special district for the theme park that allows it to essentially establish its own independent government.

Not in lockstep — Scott's less combative tone over Disney is another reminder of the stylistic and policy differences between the two Florida Republicans, with both being seen as potential 2024 challengers if former President Donald Trump does not run again. It also highlights other areas where the two Florida Republicans diverge, including on using federal aid and the current Russian invasion in Ukraine.

LATE-NIGHT BILL ACTION — Gov. Ron DeSantis signed 42 bills into law on Wednesday, with the notice going out in the evening. Among the measures he signed was a tweak to a law that has already been blocked by a federal judge. The governor signed HB 921, which among other things, limits donations to groups supporting and opposing citizen initiatives to just $3,000 if the donation is from an individual or political committee. The cap applies to the critical period when groups are gathering signatures but is lifted if the measure makes the ballot.

Rinse. Lather. Repeat — Does this seem familiar? Why yes it should. Last year, lawmakers — after being warned it was likely unconstitutional — placed a $3,000 cap on ALL donations to citizen initiative campaigns prior to the proposed constitutional amendments making the ballot. A federal judge appointed by former President Donald Trump last July temporarily blocked the law and the state did not appeal that ruling. U.S. District Judge Allen Winsor concluded that the state had no "sufficiently important government interest" to support curtailing First Amendment rights by limiting the amount of donations to groups backing citizen initiatives.

Jeff Brandes is urging legislative leaders from his own party to call a special session to fix Florida's ailing property insurance market, an issue lawmakers failed to reach a deal on during the 2022 legislative session. The St. Petersburg Republican, who has a reputation for challenging leadership, has been one of the loudest voices on property insurance reform. He has said previously lawmakers should return to Tallahassee after the House and Senate couldn't overcome differences on legislation dealing with the state's property insurance market, which Democrats are using on the 2022 campaign trail to highlight inaction from GOP-majorities.

End around — If legislative leaders do not call a special session, Brandes said he would formally poll member of the Legislature about whether they should return for a special property insurance session. Under state law, if Brandes got the support of 31 lawmakers, the Department of State would have to poll the entire Legislature about the idea. If three-fifths in both the House and Senate agree a special session is needed, lawmakers would return to Tallahassee.

The U.S. Food and Drug Administration last week held its first meeting with five states, including Florida, to introduce the Section 804 Importation Program. The program requires states to submit importation plans, known as an "SIP," for final approval by the FDA. The FDA held discussions with the five states because they are already well into the application process. The video meeting attracted at least 38 virtual attendees, many of them from other states.

Trump has previously endorsed in six other congressional races in the state … Former Florida Attorney General and chair of the Make America Great Again, Again Super PAC Pam Bondi has endorsed Senate President Wilton Simpson in his race for agriculture commissioner …. Sean Shaw, a former state legislator who was the first Black nominee for Florida Attorney General, has endorsed Aramis Ayala. Ayala, a former elected prosecutor from Central Florida, is one of three Democrats running against incumbent Ashley Moody. Shaw said in a statement that "from day one as state attorney, Aramis demonstrated unfaltering leadership, introducing groundbreaking justice reforms and eliminating practices that upheld systemic racism or penalized poverty."

IRAN CONCERNS — Rep. Val Demings, the Orlando Democrat challenging Sen. Marco Rubio , joined with other House Democrats on Wednesday to raise questions about efforts to make a new deal with Iran over its nuclear program. "As a 27-year law enforcement officer and chief of police, I know a habitual offender when I see one. Iran's corrupt leaders are habitual offenders, sponsors of terror, and a threat to U.S. national security, Israel, and stability around the world," Demings said in a statement. "I continue to support all efforts to destroy the Iranian government's terror networks, break up their ballistic missile program, disrupt their meddling in Latin America, and gut their nuclear program."

But wait — Rubio's campaign is questioning Demings stance, noting her past statements where she defended the previous Iran deal that former President Donald Trump withdrew from.
