CMS Releases State Health Official Letter and FAQs on Sections 5121 and 5122 of the CAA, 2023

Today, CMS issued a State Health Official (SHO) letter and frequently asked questions (FAQs) that provide additional guidance to states on sections 5121 and 5122 of the Consolidated Appropriations Act, 2023 (CAA, 2023). These sections of the CAA, 2023, set new requirements for Medicaid and Children's Health Insurance Program (CHIP) coverage for youth who are being released from public institutions.

The FAQs address the applicability of requirements to federal prisons and clarify state Medicaid and CHIP program obligations to support implementation of the coverage, eligibility, and enrollment activities required. This letter supplements the July 2024 SHO Provision of Medicaid and CHIP Services to Incarcerated Youth, which provided initial guidance to agencies on the requirements.
