Good afternoon. Today's newsletter, edited by Sam Baker, is 490 words, a 2-min. read. Thanks to Sheryl Miller for copy editing.

⚖️ Bulletin: Special Counsel Jack Smith filed a new indictment in former President Trump's Jan. 6 case, to account for the Supreme Court's ruling that Trump cannot be prosecuted for official acts.

  • Smith reframed his charges in light of that ruling but didn't drop any of them.
  • The new indictment argues that Trump did not have any official constitutional duties related to certifying the election — meaning that interfering with that process wouldn't be an official act.

1 big thing: Big Tech leans away from moderation

Big Tech seems to be shifting to the right — at least rhetorically — on content moderation.

  • Several social platforms have course-corrected after what they consider a content moderation overreach during the 2020 election and the pandemic. Ahead of the 2024 race, they are standing their ground, Axios Media Trends author Sara Fischer writes.

💬 The latest: Meta CEO Mark Zuckerberg accused the Biden administration of pressuring Facebook to "censor certain content" related to COVID-19.

  • "I believe the government pressure was wrong, and I regret we were not more outspoken about it," he wrote in a letter to the House Judiciary Committee.
  • Zuckerberg and former Twitter CEO Jack Dorsey have both said their platforms mishandled stories about Hunter Biden.
  • And the arrest of Telegram CEO Pavel Durov galvanized tech figures — like Elon Musk — who consider themselves "free-speech absolutists."

🚔 Yes, but: Walking the walk on free-speech absolutism allegedly allowed Telegram to become a hotbed of criminal activity.

About 61 million people are under heat watches and warnings as yet another brutal summer heat wave grips much of the U.S., Axios' Andrew Freedman reports.

  • ☀️ Chicago was expected to see high temperatures today that are 20 degrees higher than average for this time of year. Heat restrictions were in place for the first day of classes in the city's public schools.
  • D.C. will get another blast of heat tomorrow, with highs near 100°.

Hotel loyalty programs are booming in popularity — which means hotels have pulled back on the actual rewards, The Wall Street Journal reports.

  • Discounts, upgrades and other perks now require more points than they used to, especially in popular destinations.

💳 "These programs have followed the path of airlines," John Ollila, who analyzes travel loyalty programs, told the WSJ. "They have become less rewarding for those who stay at their hotels, and more emphasis is placed on revenue that various partnerships and credit cards drive."
